1. Agreement to These Terms
These Terms of Service (the "Terms") govern your use of the website www.variatehealth.com (the "Site"), operated by Variate Health, Inc. ("Variate Health," "we," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. The Variate Health Platform
Access to the Variate Health platform (the "Service") is provided to customers under separate written agreements, including order forms and, where applicable, Business Associate Agreements. If there is a conflict between such an agreement and these Terms with respect to the Service, the written agreement controls. Nothing on the Site is an offer to provide the Service except as set out in such agreements.
3. No Medical Advice
Content on the Site is provided for general information about our products and company. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the professional judgment of qualified clinicians.
4. Intellectual Property
The Site and its content — including text, graphics, logos, product screenshots, and software — are owned by Variate Health or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, revocable license to access and use the Site for informational and evaluation purposes. No other rights are granted.
5. Acceptable Use
You agree not to: use the Site in violation of any law; attempt to gain unauthorized access to the Site or related systems; probe, scan, or test the vulnerability of the Site or breach its security or authentication measures; scrape, harvest, or bulk-extract Site content or data, including for training machine-learning models, without our prior written permission; interfere with the operation of the Site; or misrepresent your affiliation with any person or entity.
6. Feedback and Submissions
If you send us ideas, suggestions, or feedback, you grant us the right to use them without restriction or compensation. Please do not send confidential information through the Site.
7. Third-Party Links
The Site may link to third-party websites. We are not responsible for their content or practices, and a link does not imply endorsement.
8. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARIATE HEALTH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). CLAIMS RELATING TO THE SERVICE ARE GOVERNED BY THE APPLICABLE WRITTEN AGREEMENT.
10. Indemnification
You agree to indemnify and hold harmless Variate Health and its officers, directors, and employees from claims arising out of your breach of these Terms or your misuse of the Site.
11. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Francisco County, California.
12. Changes to These Terms
We may update these Terms from time to time. Updated Terms take effect when posted on this page. Your continued use of the Site after posting constitutes acceptance.
